CUSTOMER TERMS (EULA):

THE MERCURY REPORT is a DIGITAL GOODS PRODUCT that is emailed to Pre-Paid or active Monthly (recurring payment) customers. When you order the MPR, you will be emailed your first issue, after payment is received, usually within 4 hours during business hours of 10AM-6PM.  If you do not receive the Report within 4 hours, please email us at themercuryreport@hotmail.com

The MP Report comes out on Mondays; yet may be sent (emailed to customers) as late as Tuesday afternoon. We do our best to get it to customers on Mondays

There are TWO TYPES - Standard (no add-ons) or Premium (Report and Email Blaster add-on) to choose from - once you decide if you want just the Report or the Report with Email Blaster... you can then choose from 3 PAYMENT OPTIONS.

The following payment options are available to choose from on the next page:

YEARLY PAYMENT CUSTOMERS:
You can place your MPR email delivery on hiatus (up to 3 months) when book a gig-- just email us and we will put your delivery on hiatus for up two months; when you return or in 3 months time, we will resume weekly delivery again and add the time (up to 3 months) to the end of your term, so you get the full year that your ordered.

SIX MONTH PAYMENT CUSTOMERS:
You can place your MPR delivery on hiatus for up to 2 months... just email us and we will put your delivery on hiatus for up two months; when you return or in 3 months time, we will resume weekly delivery again and add the time (up to 3 months) to the end of your term, so you get the full year that your ordered.

MONTHLY PAYMENT CUSTOMERS: You may cancel your MONTHLY PAYPAL RECURRING PAYMENT SUBSCRIPTION at any time by logging into YOUR PAYPAL ACCOUNT -- go to your payment subscriptions (authorized subscriptions) dashboard and cancel your payments there.  

MONTHLY CUSTOMERS must cancel BEFORE YOU NEXT SCHEDULED PAYMENT though or PayPal will make the next payment. You will still receive all issues (one per week for one month) for which you paid even after canceling your subscription, if there are still weeks left on the month before your established due date when you cancel.

SIX MONTH and YEARLY CUSTOMERS have PRE-PAID for specified terms and receive a discount over the MONTHLY RATE, so there is no recurring payment to cancel; also there is no canceling your 

CUSTOMERS who order THE MERCURY PRODUCTION REPORT (Production Listings) will recieve listings each week, delivered to your email INBOX, to the email address on your PayPal order/Account.

CUSTOMERS who order the THE MERCURY PRODUCTION REPORT & EMAIL BLASTER ADD-ON, will recieve both weekly... you will also be emailed an IMPORTABLE EMAIL CONTACTS FILE (containing email addresses from that week's listings), with their weekly MERCURY PRODUCTION REPORT LISTINGS.   

ALL CUSTOMERS agree that once we have emailed you THE MERCURY PRODUCTION REPORT to the email address on your PayPal account - and you open that email - we have delivered THE MERCURY PRODUCTION REPORT to you - therefore, ALL CUSTOMERS AGREE to NO REFUNDS since the DIGITAL GOOD was delivered - please note: we track delivery of each issue.  So please do not DISPUTE PAYMENTS with PAYPAL.

DELIVERY and FORMAT:

The Report is sent out as a PDF document in ENGLISH.

If you would like the report in a foreign language, tell us in an email.

All payments are non-refundable, EXCEPT for DUPLICATION PAYPAL TRANSACTIONS (we refund duplicate orders automatically as soon as we see them)

NO REFUNDS except for subscribers who accidentally make duplicate orders (PayPal payment transactions) at time of purchase. Recurring monthly payments are NOT DUPLICATE ORDERS.

The easiest way to RESOLVE ANY PROBLEMS is to CONTACT US FIRST. We get a few disputes and feel the disputes are made because the subscriber failed to cancel his/her subscription and canceled after an automatic payment, then wanted their money back.

If you order the report and later make a dispute claim against us, we defend against disputes and it may take PayPal up to three months to return your money if they have to contact your credit card provider, even if you win.  Contact us first, before making any dispute claims. Most disputes are that they did not receive the report. Emailing is not 100%, many people have spam blockers, junk boxes etc..it’s your responsibility to contact us if you do not receive the report on time.  We do track delivery, so claims of not receiving the report can be verified.  If there is a problem, we will fix it and compensate you as describe above for non delivered issues to the proper email address.

MONTHLY PAYMENT CUSTOMERS:

Payments are only processed through PayPal; once registered, your MONTHLY RECURRING PAYMENTS will automatically be renewed (from one month to the next) and your account will automatically be charged $52.00 every month until YOU cancel your PayPal Recurring Payments Subscription by logging into your PayPal Account and canceling it there. For instructions on how to cancel your subscriptions please contact your payment system’s customer service.

You have complete control. You can cancel your MONTHLY SUBSCRIPTION at any time day or night simply by logging into your PayPal Account and canceling your payment subscription there.

You agree that you are solely responsible for canceling your MONTHLY SUBSCRIPTION. Thus any dispute claims that any subscription payment was “unauthorized” due to “non-cancellation of subscription” is null and void.

After the cancellation, you’ll be supplied the weekly listings until the end of your current payment period.

If you are going on vacation or are working on a production and can’t use The Mercury Production Report, you are advised to cancel your monthly subscription and reorder when you return. We do not offer any courtesy of subscription delivery hiatus to monthly subscribers.

SIX-MONTH and YEARLY CUSTOMERS:

Payments are only processed through PayPal; once registered, your account will be charged a one-time payment for the duration of your subscription; your subscription will not automatically renew. At the end of your subscription you can order a new one.

Six-Month and Yearly Subscriptions CANNOT BE CANCELED; thus you agree to not file any dispute claims of non-cancellation or non-delivery. We do offer remedy for non-delivery of issues below and when you work a long term gig, you can place delivery on hiatus as describe above.

You may request a TEMPORARY HIATUS OF PRODUCTION LISTINGS WEEKLY DELIVERY, where we may suspend delivery of issues to you for up to two months and resume delivery after two months or when you contact us if less than two months; we then add the suspended time  (weeks deliver was on hold) to the end of your subscription without charge, so you get the full 6 months or year you ordered.

If you are unfamiliar with our data then you are advised to order a Monthly Subscription in order to decide if you will be satisfied with it before committing to a six-month or yearly subscription as Six-Month and Yearly subscriptions cannot be canceled. You are choosing the option to get a discount on your subscription charge by paying for a pre-determined subscription length; due this discount we don not offer the option of canceling such subscriptions.

REQUESTING SUSPENSION OF DELIVERY:
If you get work or are going on vacation and wish to suspended the delivery of your six-month or yearly subscription, you may request that we suspend your subscription for up to two months.

During your requested suspension, you we will not deliver issues to you and at the end of your subscription we will extent your subscription length by the same amount of time as you requested we suspend it (up to two months.).

For example, if you get a Yearly Subscription (One Year) and you are working on a production for two months and request a two month suspension of your subscription any time during your subscription, we will add two months to the end of your subscription thereby extending it without charge.

It is your responsibility to notify us by emailing info@mercuryprods.com that you want your subscription suspended and if needed, to remind us to extend your subscription. Please email us again before your leave to confirm we have recorded your suspension request.

We may not suspend a six-month or yearly subscription longer than three months. You may only request one suspension during your subscription. 

PREMIUM CUSTOMERS ONLY:  Customers who also order our EMAIL BLASTER add-on with their MERCURY PRODUCTION REPORT -- you will also be emailed an EMAIL CONTACTS file containing the Email Addresses that were listed in the current week's Mercury Production Report issue.  The Email Blaster file is a list of contacts you can import into YOUR EMAIL ADDRESS BOOK and use to email out your PROMO - send to individual contacts, or send a broadcast email to the whole list.  Each week, import new contacts and watch your contact list grow with the help of THE MERCURY PRODUCTION REPORT and EMAIL BLASTER add-on!

ALL CUSTOMERS:

RETURNS AND REFUNDS:

We do not accept returns since the Report could still be Saved from an email and used and No Refunds of payments will be given EXCEPT FOR DUPLICATE ORDERS. IF YOU ACCIDENTLY CREATED DUPLICATES OF YOUR ORDER IN PAYPAL, WE WILL SEE IT AND REFUND DUPLICATE ORDERS ASAP.  DO NOT PLACE DUPLICATE ORDERS IN DISPUTE OR IT WILL TAKE LONGER TO GET YOUR FUNDS REFUNDED AS PAYPAL WILL PLACE A HOLD ON THE DUPLICATE ORDER AND WE CAN'T HIT "REFUND" WITH A HOLD ON THE TRANSACTION.   You agree that data is “non-returnable.” You agree to NO REFUNDS for any reason except for duplicate orders (showing in PayPal) and no other compensation of any kind except as described below for “non-delivery of goods” or “non-suspension of six month or yearly subscription.”

You thus agree to never file a dispute or chargeback claim, claiming “unauthorized charges”, “goods not as described” or “non-delivery of goods” with PayPal or any credit card provider or banking services provider for any payments made to us in effort to reclaim those payment monies for any of the following reasons:

(1) SUBSCRIPTION NOT CANCELED (You are responsible for canceling YOUR PAYMENT SUBSCRIPTION)
(2) NOT SATISFIED WITH GOODS/GOODS NOT AS DESCRIBED
(3) NON-DELIVERY OF GOODS (We track delivery)
(4) NON-SUSPENSION OF DELIVERY OF A SIX-MONTH OR YEARLY SUBSCRIPTION

REMEDIES or SETTLEMENT WE DO OFFER FOR THE ABOVE CLAIMS:

SUBSCRIPTION NOT CANCELED: You can cancel you own Monthly payment subscription yourself by logging into your PayPal Account and canceling your subscription there; thus you agree to no compensation for the “non-cancellation of your subscription" because you are in control of your payment subscription.

NON-SATISFACTION WITH GOODS: You agree that data is not returnable, which is why we offer a monthly subscription, so you can try out our data and cancel your monthly subscription if you are unsatisfied, thus you agree to no compensation for any “non-satisfaction” of goods or services or “goods not as described”.

NON-DELIVERY OF GOODS: If for any reason we failed to deliver the data to you after you have reported to us the non-delivery of any issue within the same week and given us the opportunity to resend the issue to you, but didn’t, we will make it up to you at the end of your current paid subscription, by EXTENDING YOUR DELIVERY TERM FREE OF CHARGE ONE WEEK FOR EACH PREVIOUSLY UNDELIVERED ISSUE, thus settling any claims of non-delivery of data. Thus, you agree to no other remedy or compensation for “non-delivery” of goods.

NON-SUSPENSION OF DELIVERY FOR SIX-MONTH and YEARLY CUSTOMERS:
We are not required to PLACE YOUR DELIVERY OF ISSUES ON HIATUS for any reason; we offer this option to our six-month and yearly subscribers only as a courtesy; thus if we fail to extend this courtesy to you, we are not at fault for the “non-suspension of delivery.” We do not offer this courtesy to our Monthly Subscription subscribers since Monthly Customers can cancel their recurring payments.

For any disputes or claims, YOU agree to the sole remedy and settlement of any dispute or claim is the “extension of your subscription, at the end of your paid subscription, for a time period established at our sole determination, without charge.”

Thus any dispute or chargeback claims that any subscription payment was “unauthorized” due to “non-cancellation of subscription”, “non-satisfaction of goods or services”, “goods not as described” or “non-delivery of goods” or “non-suspension of delivery of a six-month or yearly subscription” is null and void.

NON-DELVERY OF GOODS:

HOW TO REPORT NON-DELIVERY OF GOODS:

During your subscription if you do not receive the week’s data (The Mercury Production Report) by Tuesday at Noon, you are required to report the non-delivery of that week’s issue by emailing us at info@mercuryprods.com no later than the Friday of that same week, so that we may resend it to you. After contacting us, if you do not receive your issue within one day, then email us again.

HOW WE SETTLE NON-DELIVERY OF GOODS CLAIMS WITH YOU:

If for some reason we fail to deliver an issue to you after you emailed us two times requesting we resend an issue, then we will add one week for every issue we failed to deliver to you onto the end of your subscription, thereby extending your subscription free of charge to makeup for the non-delivered issues. You agree to this policy in lieu of any refund of payments made or any other kind of compensation.

If you fail to contact us within the same week that you did not receive an issue, you agree that you forfeit your right to that week’s Issue and any settlement extension of your subscription.

We are not required to add on time to your subscription for forfeited issues; however we may do so at our sole discretion if we believe extenuating circumstances exist.

DELIVERED DATA:

For personal or inter-office use only, forwarding, duplication or redistribution is prohibited without expressed written consent from the editor. Information subject to change without notice, credits may not be contractual. The MPR has invisible tracking and delivery and forwarding can be confirmed.

Production Companies may change start dates, office locations, phone numbers, email addresses, personnel or production offices, cast or crew at any time, thus the accuracy of information supplied is not guaranteed.

This data contained in any MPR issue, or add-on resource, such as the Email Blaster/Database Builder file, or Email List, is provided as a RESOURCE for customers’ growth marketing plans and customers’ networking of current and future entertainment productions. No warranty as to the accurate of any information provided is made or implied. YOU agree to use THE MPR and any add-on resources at your own risk. THE MPR is not a job referral or employment service. There is no promise of openings on any of the productions listed, of job placement or of career advancement.
